1. General

1.1 www.collectiblesdirect.co.uk (hereinafter referred to as "website") is owned and operated by Collectiblesdirect UK Limited (hereinafter referred to as "we/us/our, Collectiblesdirect"). The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as "you") with us at this website.

 1.2 By using this website and/or placing an order you agree to be bound by the terms and conditions set out herein (the "Terms"). Please make sure you have read and understood the terms and conditions before placing your order.

 1.3 We reserve the right to change these terms and conditions from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on the website at the time you place your order.

 1.4 If you have any queries about these terms and conditions or if you have any comments or complaints on or about our website, you can contact us at [email protected].

 1.5 You must have a unique email address to use our site. You agree that e-mail can be used as a long-distance means of communication, and you agree all notices made via e-mail satisfy any legal requirements that such notices be made in writing

 

2. Prices and delivery charges

2.1 The prices displayed at the website are in UK sterling (£) and include the Value-added Tax (VAT) at the current rates (20%).

2.2 We make every effort to ensure that prices listed on the website are correct at the time of entering information. However, errors may occur and we reserve the right to alter product prices on this website without notice. Other reasons for price alteration may include (but are not limited to) taxation changes or other duty increases.

2.3 In the event that we change the price of an item due to an error, we will inform you as soon as possible of the amendment and of the correct price. You may choose to fulfil your order at the correct price or to cancel your order. If you choose to cancel your order and has already paid for the goods in question, we shall refund the full amount in accordance with these Terms and Conditions. You should be aware that a pricing adjustment due to a promotion, sale or other offer is not considered an error in price by us and the above Terms do not therefore apply.

2.4 Delivery charges vary according to the type of goods ordered. If we are unable to deliver your order in full and have to make more than one delivery, there will not be an additional charge for the subsequent deliveries.

 

3. Ordering/ conclusion of the contract

3.1 The ordering option available to you is only via our website.

3.2 Only persons over eighteen years of age with a residential address can place an order.

3.3 The technical steps required to create the contract between you and us are as follows:

- The display of items for order on the website is only an invitation to treat and your payment of the price for the goods represents an offer on your part to purchase the goods

- You will be guided through the process of placing an order by a series of simple instructions on the Website. You are able to correct errors on your order up to the point on which you click on the confirm order button during the ordering process. We advise you read the terms and conditions first before you place the order for your products on the website by pressing the confirm order button at the end of the checkout process.

-  We will send to you an order acknowledgement email detailing the products you have ordered and price for delivery. This is not an order confirmation or order acceptance from collectiblesdirect.co.uk.

- All orders are subject to acceptance (referring to clause 3.5). As your product is shipped from our warehouse we will send you a despatch confirmation email.

3.4 A contract between you and us will come into existence when we charge the full amount of your orders with your credit or debit card for the purchase of the product or accept your payment from other means i.e. Paypal.

3.5 Non-acceptance of an order may be a result of one of the following:

- The product you ordered being unavailable from stock including pre-order products.

- Our inability to obtain authorisation for your payment.

- The identification of a pricing or product description error.

- You are not meeting the eligibility to order criteria set out in the Terms & Conditions.

 3.6 This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with the law of Scotland. Parties to any such contract agree to submit to the exclusive jurisdiction of the Scottish Courts. All contracts are concluded in the English language.

 

4. Cancellation by us

4.1 We reserve the right to cancel the contract between us if:

-  we have insufficient stock (including any products on pre-order) to deliver the goods you have ordered;

-  we do not deliver to your area; or

-  One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

4.2 If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit/debit card. For payments paid via direct debit, the refunds will be credited to your account with us as store credits.

 

5. Availability

5.1 We sell a number of limited edition products on this website. The release date listed on this website is based on the information received from the supplier of the item. We will not be held responsible if that item is delayed or cancelled or if the content or cover art has changed.

5.2 We endeavour to fulfil your order. However, once the supply of the limited edition item is exhausted and the Customer’s order cannot be fulfilled, Collectiblesdirect will cancel the Customer’s order and no costs will be charged to the Customer’s account. Collectiblesdirect will not be responsible for compensating the Customer for any other losses connected with the purchase of limited edition products.

 

6. Processing of orders

6.1 Processing of pre-orders may begin earlier than the release date to ensure that orders can be shipped to you in time for the release date.

6.2 Collectiblesdirect aims to arrange shipment of all ‘in stock’ items within 24 hours of receiving your order. Your order may be delayed if the item is not in stock with our suppliers or we are experiencing a high volume of orders. Some items may be unavailable and the current stock status is approximate. Collectiblesdirect.co.uk is not able to supply dates when our suppliers may get an item in stock.

6.3 You can keep track of your order status yourself on-line with the order tracking facility on your account page

 

7. Delivery

7.1 Our delivery charges are set out under "Shipping" on our website.

7.2 We will deliver the goods to the address you specify for delivery in your order, including the Isle of Wight, the Isle of Man, the Scottish Isles, parts of Scotland, Northern Ireland, the Channel Isles ( not including any P.O Box addresses)  and any other places worldwide though you will be required to pay extra for delivery to these regions. It is important that this address is accurate. Please be precise about where you would like the goods left if you are out when we deliver. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence).

7.3 We aim to deliver within 1 to 3 working days following confirmation of an order for the in-stock item (Deliveries to the Isle of Man, Northern Ireland and the Scottish Islands normally take 3 to 5 working days.). If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time.

7.4 You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

7.5 If delivery is delayed through your unreasonable refusal to accept delivery or if you do not (within one week of our first attempt to deliver the product to you) accept delivery or collect the product from the carrier, then we may (without affecting any other right or remedy available to us) do either or both of the following:

      a) charge you for our reasonable postage fee (£12.00 or a normal size parcel for delivery address within the UK mainland or £35.00 for part of other EU countries. Oversized parcels will be charged with extra surcharge) and other costs reasonably incurred by us, plus a 10% restocking fee; or

      b) no longer make the product available for delivery and notify you that we are immediately cancelling the applicable contract, in which case we will refund to you or your credit or debit card company as applicable any money already paid to us under the applicable contract, less our reasonable administration charges (including for attempting to deliver and then returning the product, and any fees occurred).

 

8. Right to Cancel and Returns

8.1 Under the Distance Selling Regulations you have the legal right to cancel your order within seven working days from the point of order to receive a full refund including delivery charge. For pre-orders or in-stock items on layaway plan, unless orders are cancelled within 7 calendar days from the point of order, a cancellation fee, which is 10% of the total value of the order to be cancelled, will be charged. Please note for payments paid by Paypal or bank cards over 180 days, we are not able to issue refunds to your original payment account but store credit in your account with us. For payments paid via direct debit, the refunds will be credited to your account with us as store credits.

      Please note that we cannot cancel an order once it has been dispatched.

8.2 You must contact us before sending any items back to us. Please note that if your order has already been dispatched, we will request that your order is returned prior to a refund being offered. Please see the returns policy below for more details.

**Unwanted items
 

In the unlikely situation that you wish to return your goods under the Distance Selling Regulations, we will accept the return of goods sent back to us within 14 calendar days of receipt.


If the unwanted items are unopened (which means either the factory seals or our seals as we need to open boxes to check content conditions) and returned in their original condition including tags and packaging, we will refund you the money which you have paid us for those items, or offer you an alternative product of similar value as a replacement if required.

You will be responsible for the payment of the return postage of the unwanted goods and our original postage costs to you. Refunds on items with which had free delivery will be charged the normal delivery costs (minimum £12.00, the exact cost depends on the service we use) once the goods are returned. And there is a 10% of the order total as restock fee will be charged. For payments paid by bank cards over 180 days, we are not able to issue refunds to your original payment account but store credit in your account with us. For payments paid by direct debit, we can only refund the payments to your account with us as a store credit due to direct debit payments are non-refundable.

We are not able to accept the return of opened and/or part used goods.

**As we don't use Paypal any longer, any payments paid via Paypal can only be refunded as a store credit.
 
**Faulty or Defective Items

If replacements are available, we will send the replacements free of charge as the priority option. Return for a full refund is only available in the case of no replacements available from us or our supplier and the manufactory. Please understand the waiting time for replacements varies with different brands from several weeks to months.
 
In the event that an item is defective, faulty or sent in error by us, you may return the item(s) by post or may contact us to arrange a courier to retrieve the item(s) within 14 calendar days from the day after the item was dispatched to the buyer to qualify for an exchange or refund.
 
Due to the complexity of certain products, no exchanges can be given on selected items. 

We will refund the cost of the item plus the cost of any postal or courier charges paid by the customer as part of their initial order (except Saturday special delivery service within the UK mainland). 

For orders to be shipped out of the UK, the original shipping cost non-refundable because there is no standard delivery option available but only the Express delivery service by carrier companies. Customers need to cover the return postage and we cover the postage for sending replacements.
 
Please note that 'defective' means the item doesn't work properly i.e. lights-up function doesn't work. Any painting problems are not covered.
 
We are not responsible for quality control, we are only a retailer.
 
We recommend that you use a secure delivery method that requires a signature upon receipt (such as via Royal Mail First Class Recorded Delivery) as you will be responsible for the returned products until they reach us.
 
Your refund will be processed within 14 calendar days of receipt of the return. For payments paid by bank cards over 180 days, we are not able to issue refunds to your original payment account but store credit in your account with us. For payments paid by direct debit, we can only refund the payments to your account with us as a store credit due to direct debit payments are non-refundable.

**As we don't use Paypal any longer, any payments paid via Paypal can only be refunded as a store credit.

 

9. Payment methods

 

9.1 You can currently use credit/debit cards as payment methods at the time you place your order at our site.

9.2 We offer you a new service of buying products with our Layaway Plan (Flexpay), which means you can pay your orders with INSTALLMENTS.

9.3 We offer you a Direct Debit payment method via Gocardless, which means you can pay your orders with a fixed monthly payment. For payments paid via direct debit, the refunds will be credited to your account with us as store credits.

 

Layaway Plan payment clearing time period limit

 There is a time limit for paying off the full amount with your orders on the Layaway Plan.

1. For in-stock items, you need to clear the full amount in 1 month, within this you can pay as many times and amounts as you like.

2. For pre-order items, you need to clear the full amount in 1 month after your pre-orders are in stock. We will send you a notice by email to inform you that your preorders are in stock. So you can choose either clear the full amount in time or in 1 month.

3. If you don't clear the full amount at the end of the time period limit, your order will be cancelled and we will charge you a cancellation fee.

Layaway Plan orders cancellation fee

Due to the bank charges of accepting payments,  we will charge Layaway Plan orders a cancellation fee when a Layaway Plan order is cancelled by the customer or collectiblesdirect (due to customer fail to pay the full amount within the agreed time limit).

The fee will be 10% of the total value of your orders for cancellations (also known as the 10% non-refundable deposit), any additional payment will be credited to customers' account with us (which is known as store credit). By choosing the Layaway Plan option when placing your order, you will be agreeing to pay any applicable cancellation fee. This is clearly noted in our Terms and Conditions during check out. We strongly recommend that you read our Ts &Cs before placing orders.

   

10. Liability

10.1 If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we will have no liability to you unless you notify us in writing at our contact address of the problem within 60 days of the date on which you ordered the goods (unless in the event of purchasing pre-order products). If you notify a problem to us under this condition, our only obligation will be, at your option:

-  to make good any shortage or non-delivery;

-  to replace or repair any goods that are damaged or defective; or

-  to refund to you the amount paid by you for the goods in question in whatever way we choose.

10.2 Both parties shall only be liable under this contract for losses, which are a reasonably foreseeable consequence of the relevant breach of contract.

10.3 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

10.4 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

 

11. Protection of privacy

11.1 The data Protection Act 1998 sets out requirements for how we store and disclose your personal information. We assume responsibility for all personal information that you make available to us.

12. Ownership of rights

All rights, including copyright, in this website, are owned by or licensed to Collectiblesdirect UK Limited. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose.

 

13. Accuracy of content

We have taken care in the preparation of the content of this website, in particular, to ensure that prices quoted are correct at the time of publishing and that all goods have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. Any weights, dimensions and capacities given about the goods are approximate only.

 

14. Damage to your computer

We try to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

 

15. Notices

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address and all notices from us to you will be displayed on our website from to time.

 

16. Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

 

17. Third-party rights

Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.

 

18. Affiliate Program Terms & Conditions

  Joining the Program

By filling out the signup form, and upon acceptance, you will become an affiliate and are bound by the terms of this agreement. Your participation in the program is solely for this purpose: to legally advertise our website to receive a commission on products purchased by your referred individuals.

Affiliate Responsibilities

It is understood that you will introduce COLLECTIBLESDIRECT.CO.UK and services to your current and prospective customers and will comply with all laws as well those that govern email marketing and anti-spam laws. Interspire reserves the right to accept or reject any prospective customers and will pay you a commission per customer referred using your affiliate code according to the designated payment schedule.

Either you or COLLECTIBLESDIRECT.CO.UK may terminate the Affiliate relationship at any time.  COLLECTIBLESDIRECT.CO.UK may change the program or service policies and operating procedures at any time.

Affiliate Relationship

This Affiliate relationship is one of the independent contractors. COLLECTIBLESDIRECT.CO.UK will not be liable for indirect, special or consequential damages arising in connection with this program and our aggregate liability arising with respect to this program will not exceed the total referral fees paid or payable to you. We make no express or implied warranties or representations with respect to the program. In addition, COLLECTIBLESDIRECT.CO.UK makes no representation that the operation of the service will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.

Revocation of Affiliate Status

Your affiliate application and status in the program may be suspended or terminated for any of the following reasons:

Affiliate Links

You may use graphic and text links both on your website and in emails. The site may also be advertised "offline" in classified ads, magazines, and newspapers. You may use the graphics and text provided to you by us, or you may create your own as long as they are deemed appropriate according to the conditions above.

Affiliate Tracking

When a web surfer clicks through your affiliate link, a cookie is set in their browser that contains your affiliate username. Also, their IP address is tracked in the database along with your affiliate name. When this person decides to buy a product, the script will look for this cookie and/or try to match their IP address to identify the affiliate who will be awarded the commission. Visitors sent through your affiliate link may make a purchase later in time and the commission will still be awarded if the cookie is present in their browser and/or they are using the same IP address as the one logged in the database.

Terms of the agreement

These terms will begin upon your signup with the affiliate program and will end when your affiliate account is terminated. The terms of this agreement may be modified by COLLECTIBLESDIRECT.CO.UK at any time. If any modification to the terms is unacceptable to you, your only choice is to terminate your affiliate account. Your continuing participation in the program will constitute your acceptance of any change.

Liability

We will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, and any results of "intents of harm" to the program or our website. We do not make any expressed or implied warranties with respect to the affiliate program and/or products sold at this site. We make no claim that the operation of the affiliate program and our website will be error-free and we will not be liable for any interruptions or errors.
